California Motorcycle Accident Attorney

Lane splitting, rider bias and serious-injury claims

Motorcycle claims carry an additional obstacle: assumptions about the rider. Insurers frequently open with the position that a motorcyclist was speeding, filtering unsafely, or otherwise responsible, before the evidence has been examined.

Lane splitting is lawful in California

California permits lane splitting, and it is not by itself negligence. Whether a particular manoeuvre was reasonable depends on speed differential, traffic conditions, lane position and visibility. That distinction matters, because an insurer may treat the fact of lane splitting as though it settled the question of fault.

Injuries in motorcycle collisions

Riders lack the structural protection of a vehicle, so the same impact produces different injuries, including orthopaedic trauma, road rash requiring ongoing treatment, and head injuries even where a helmet was worn. Documentation focuses on the full course of treatment rather than the initial emergency visit.

Evidence that supports a rider's account

  • Helmet-camera or dash-camera footage from any vehicle involved.
  • Scene photographs showing lane positions, debris and sight lines.
  • The motorcycle itself, before repair or disposal.
  • Independent witness accounts, collected early.
  • Protective gear, which can corroborate impact and speed.

Drawing on former insurance-defense experience, the firm investigates liability, identifies available coverage, documents damages, negotiates with carriers, and prepares cases for litigation when necessary.

Matters are generally handled on a contingency-fee basis. Attorney fees are not owed unless a recovery is obtained; clients may remain responsible for costs as stated in the written fee agreement.
